Terms of Service

These Terms of Service ("Terms") govern your use of the Mila service ("Service") operated by Mila ("we", "us", "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Service Description
Mila provides a personal AI assistant delivered through WhatsApp. The Service enables you to:
- Converse with an AI assistant in natural language (Hebrew and English).
- Send and receive voice messages processed through speech recognition and text-to-speech technology.
- Request the assistant to send messages to your contacts on your behalf and relay their replies.
The Service is provided on an "as-is" and "as-available" basis. Features may change, be added, or be removed at our discretion with reasonable notice.
2. Eligibility
You must be at least 16 years old to use the Service. By using Mila, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account and Access
Your account is identified by your WhatsApp phone number. You are responsible for:
- Maintaining the security of your WhatsApp account.
- All activity that occurs under your account.
- Ensuring the accuracy of any information you provide.
4. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited messages, or bulk automated messages to contacts.
- Engage in any illegal, fraudulent, or harmful activity.
- Harass, threaten, or impersonate other individuals.
- Distribute malware, phishing attempts, or malicious content.
- Attempt to reverse-engineer, exploit, or abuse the Service infrastructure.
- Violate WhatsApp's Terms of Service or any applicable laws.
- Use the Service to generate content that is hateful, violent, or sexually explicit.
We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated these terms.
5. AI Limitations
Important: Mila is powered by artificial intelligence and has inherent limitations:
The AI assistant may occasionally produce inaccurate, incomplete, or inappropriate responses. It is not a substitute for professional advice (legal, medical, financial, or otherwise). You should independently verify any important information provided by the assistant.
We are not liable for decisions or actions you take based on the assistant's responses.
6. Message Relay
When you use the message relay feature to send messages to your contacts:
- You are responsible for the content of messages sent on your behalf.
- Recipients will receive messages from the Mila WhatsApp number, identified as coming from you.
- You must have a legitimate reason to contact the recipient and must not use this feature for spam or harassment.
7. Billing and Subscription
Mila is a subscription-based service. By subscribing, you agree to the following:
- Subscription fees are billed on a recurring basis (monthly or as otherwise specified).
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- We reserve the right to change pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance.
- Refunds are handled on a case-by-case basis at our discretion.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.
9. Intellectual Property
The Service, including its design, code, branding, and documentation, is owned by Mila and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
You retain ownership of the content you create and share through the Service (your messages, voice recordings, etc.).
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, including but not limited to:
- Violation of these Terms or the Acceptable Use policy.
- Abuse of the Service or its infrastructure.
- Non-payment of subscription fees.
- At your request (account deletion).
Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- Mila shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
- We are not liable for any loss or damage resulting from AI-generated content, service interruptions, or unauthorized access to your account.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Tel Aviv-Jaffa, Israel.
14. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by sending a message through the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
